acknowledgements
The Client/Model acknowledges that Peach Social Media solely creates content for social media.
Any and all media provided to the Client/Model will be in formats fit only for social media (Instagram & TikTok), & the Client/Model acknowledges that the use of Peach Social Media's product on platforms such as websites and/or print media is strictly forbidden, unless express permission is granted by Peach Social Media in writing.
The Client/Model understands that in agreeing to work with Peach Social Media, all content will be captured & edited in the style that Peach Social Media typically captures & edits in. Peach Social Media makes no guarantees that any other styles will be accommodated.
usage/posting of media
The Client/Model agrees to credit Peach Social Media (@peachmedia__) for any and all use of the content and for any additional content created by the Client/Model including, but not limited to, behind the scenes content.
Credit includes a tag (@peachmedia__) on the post, and ideally but not essentially within the caption on all social media channels.
proofs/raw media
The Client/Model understands that the proofs/raws Peach Social Media captures are the exclusive property of Peach Social Media and the Client/Model has no right to use or share the unedited media except for a license to review them.
retouching & editing
Peach Social Media will edit and retouch the Client/Model’s selected media to a standard that is in keeping with Peach Social Media's editing style.
Any additional editing requested by the Client/Model may require an additional fee which is at the discretion of Peach Social Media.
Should the Client/Model need anything specific retouched or edited, they will advise Peach Social Media prior to editing commencement, otherwise an additional fee may be required.
reel/tiktok creation
The Client/Model understands that within the agreement for Instagram Reel & TikTok video creation, Peach Social Media will allow 1 re-edit of the draft included, unless otherwise stated in writing. This is limited to a change in audio, & swapping clips of videos in or out.
It does not include full re-edit, or change of mind in terms of the content or theme used in the Reel or TikTok.
Peach Social Media reserves the right to deny making changes to initial drafts.
final edits
Final edits are to be provided electronically to the Client/Model in high resolution within 4 (four) weeks of the session. For behind the scenes (bts) raw content, Peach Social Media will provide content within 1 week (seven days).
The final edits selection is at the discretion of Peach Social Media unless otherwise discussed with the Client/Model prior to the session.
cancellation
The decision to reschedule the a booking or session is left to the sole discretion of Peach Social Media.
In the event the Client/Model cancels the booking or session with more than 48 hours notice, or does not attend or cancels within 48 hours of the session, it is at Peach Social Media's discretion if a new session is scheduled.
Peach Social Media reserves the right to cancel the booking or session due to unforeseen circumstances including, but not limited to: inclement weather, illness, emergency, or any other conditions which Peach Media deems may adversely affect the quality of the session.
The Client/Model agrees that if he or she is late to a session, such time will be deducted from the time allotted for the session. If the Client/Model is late by more than fifteen minutes, Peach Social Media may cancel or reschedule the session at Peach Social Media's discretion.
model release & copyright
The Client/Model consents and agrees that Peach Social Media has the irrevocable and unrestricted right to take or use photographs of the Client/Model (and/or their property) and to use them in any and all media worldwide including online, and for any purpose whatsoever.
The Client/Model releases to Peach Social Media all rights to exhibit this work in print and electronic form publicly or privately and to market copies. The Client/Model waives any rights, claims or interest they may have to control the use of their identity or likeness in the photographs and agree that any uses described herein may be made without compensation or additional consideration of the Client/Model.
The Client/Model further agrees to indemnify and defend Peach Social Media for all claims, demands, or lawsuits made in relation to Peach Social Media's use of the images as contemplated by this paragraph.
Peach Social Media retains the exclusive copyright protection for all images taken during the session and of all final edits.
All photographs delivered to the Client/Model are for the Client/Model’s personal use only. The Client/Model may not, without the express written permission of Peach Social Media, use the images taken during the session for professional display, profit, or other commercial endeavours.
agreement modification
This agreement is the entire agreement between the Client/Model and Peach Social Media and may only be modified as set forth in the foregoing paragraphs, in writing, and as agreed-upon by the parties.
This agreement supersedes all prior agreements between the parties.
If one or more paragraphs are found to be unenforceable or invalid, the remaining paragraphs shall remain effect and are enforceable.
Any waiver the foregoing paragraphs as agreed-upon by the parties does not alter the enforceability of the remaining paragraphs.
release of liability & indemnity
The Client/Model, upon entering into work with Peach Social Media, releases Peach Social Media from all liability & indemnity.
